Terms of Service

The website uicons.com as well as the uicons Free and Pro versions and Single or Special Sets (collectively, our „Service") is a product of Pascal Strasche („uicons“, “we“, “us“, „our“). You, the user of our Service, wether personally or on behalf of an entity („you“, „your“) agree that by accessing our Service, you have read, understood, and agreed to be bound by all of the legal terms mentioned in this legally binding agreement between you and uicons (the “Parties“).

Account

To use our Service, you must be at least 18 years old and contractually capable. Bots and other automated methods are prohibited.

You agree to keep your password confidential and will be responsible for all use of your account and password. Any breaches of security or unauthorized use of your account must be reported to us immediately upon becoming aware of them.

Your account can only be used by one person - i.e., a single login cannot not be shared by multiple people and can only be logged in from one device at a time.

Multi-Seat Plans

Multi-seat plans, such as Team, Business, or Enterprise, allow the account owner (“Team Owner”) to invite additional authorized users (“Team Members”) to access the Pro Icon Explorer under the same plan. The Team Owner counts as one seat, and each Team Member is also considered one seat. Seats are assigned to individual users and may not be shared, transferred, or used by more than one person.

Team Members are granted access in line with the features and restrictions of the chosen plan. Their ability to use the Service depends on being active within the team settings that are managed by the Team Owner. The Team Owner is responsible for inviting, removing, and managing Team Members, as well as for ensuring that all Team Members comply with these Terms. Any violation of these Terms by a Team Member will be treated as a violation by the Team Owner.

We reserve the right to suspend or terminate access to the Service for any Team Owner or Team Member if we detect misuse, unauthorized sharing, or any other violation of these Terms.

Purchase & Payment

We are partnering with Stripe for simplified billing and purchase of our Pro plans. You can manage your Pro Plan after your purchase via Stripe’s customer portal. See Stripe’s terms for more legal information: https://stripe.com/legal/end-users

You agree to provide current, complete, and accurate purchase and account information for all purchases. Sales tax may be added to the price of purchases as deemed required by us. We may change prices at any time. We reserve the right to correct any errors or errors in pricing, even if we have already requested or received payment.

We reserve the right to refuse and reverse any purchase and to limit or prohibit purchases that, in our sole judgment, appear to be placed by dealers, resellers, distributors, or other bad actors.

Refunds Policy

You can receive a refund within 14 days of purchase. However, because you can test our free version and get an accurate preview of the Pro version, we can only issue refunds due to technical issues (not already present in the free version) that render our Service unusable and cannot be resolved within a reasonable period of time.

After 14 days following the purchase of the Pro plan, your purchase is final and strictly non-refundable.

If you upgrade to a higher plan you will get a refund for the amount of your current plan. To do so please contact support@uicons.com.

Licenses

The way the Parties relate to each other is further governed by our Licenses, our Pro License: https://www.uicons.com/legal/pro-license and our Free License: https://www.uicons.com/legal/free-license (the „Applicable Licenses"). The rules of the Applicable Licenses are incorporated into these Terms of Service as if they were set forth herein and should be understood and used together.

Privacy Policy 

By using our Service, you agree to our Privacy Policy: https://www.uicons.com/legal/privacy-policy, which is incorporated into these Terms of Service. Please note that the Service is hosted in the United States. If you access the Service from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of our Service, you are transferring your data to the United States, and you expressly consent to your data being transferred to and processed in the United States.

Copyright & Intellectual Property

We are the owner and Licensor of all intellectual property rights in our Service, including the look and feel of our Service, all source code, functionality, databases, software, website designs, videos, text, images, visual elements, icons, assets, files, and graphics on our Service (collectively, our “Content”), and the trademarks, service marks and logos contained therein (our “Marks”).

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties around the world.

We reserve all rights not expressly granted to you in and to our Service, our Content and our Marks. Any violation of these intellectual property rights constitutes a material breach of our legal terms and your right to use our Service will cease immediately.

Except as set out in our Terms of Service and our License, no part of our Service and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Prohibited Activities

• You may not use our Service for any illegal or unauthorized purpose. You must not, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws) while using our Service.
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our Service, use of our Service, or access to our Service without written permission from us.
• Systematically retrieve data or other content from our Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• You must not, in our opinion, disparage, tarnish or otherwise harm us and/or our Service.
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
• Make improper use of our support services or submit false reports.
• Use our Service in a manner inconsistent with any applicable laws or regulations.
• Engage in unauthorized framing of or linking to our Service.
• Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
• Attempt to bypass any measures of our Service designed to prevent or restrict access to our Service, or any portion of our Service.
• Copy or adapt our Service's software, including but not limited to PHP, HTML, JavaScript, SVG, or other code.
• Make any unauthorized use of our Service, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
• Use our Service as part of any effort to compete with us or otherwise use our Service and/or our Content for any revenue-generating endeavor or commercial enterprise.

Governing Law

Our Licenses and Terms of Service are subject to and interpreted in accordance with German law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If you have your habitual residence in the EU and are a consumer, you will also enjoy the protection afforded to you by the mandatory legal provisions of your country of residence. The Parties both agree to submit to the non-exclusive jurisdiction of the courts of Saxony, which means that you may make a claim to defend your consumer protection rights in relation to these Terms of Service in Germany or in the EU country in which you reside.

Modifications

We reserve the right to make changes or modifications to these Terms of Service from time to time. We will alert you about any changes by updating the "Last updated" date, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms at https://www.uicons.com/legal/terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised terms by your continued use of our Service after the date such revised Terms are posted.
